释义	法律分析：一般情况下民间借贷不算高利贷，除非年利率超过36%。民间借贷利率主要分三个阶段规范。约定不超过每年24%的法院予以支持;约定高于24%不超过36%的部分，法院不予支持，但债务人已经支付了要求返还的，法院不与支持;超过36%的，借款人已经支付的可以要求出借人返还。法律依据：《最高人民法院关于审理民间借贷案件适用法律若干问题的规定》第二十六条借据、收据、欠条等债权凭证载明的借款金额，一般认定为本金。预先在本金中扣除利息的，人民法院应当将实际出借的金额认定为本金。
