释义
按合同约定计算起算时间，如果违约方明确表示或者以自己的行为表明不履行合同义务的，那么合同违约责任的计算时间主要就是看合同履行期限。刚好合同是明确规定有履行期限的，以该履行期限为准，超出则开始计算违约责任;合同不确定期限的合同的，违约方被告知的履行期限为准，超出开始计算计算违约责任;合同履行期限不明确的，以违约方被告知履行的必要准备时间为准，超出开始计算计算违约责任。
