16岁能算童工吗 |

法律分析：16岁不算童工。
1、童工通常是未满16周岁，与单位或者个人发生劳动关系从事有经济收入的劳动或者从事个体劳动的少年、儿童。
2、任何组织或者个人按照国家有关规定招用已满十六周岁未满十八周岁的未成年人的，应当执行国家在工种、劳动时间、劳动强度和保护措施等方面的规定，不得安排其从事过重、有毒、有害等危害未成年人身心健康的劳动或者危险作业。
劳动关系有如下特征：
1、劳动关系主体之间既有法律上的平等性，又具有客观上的隶属性；
2、劳动关系产生于劳动过程之中。劳动者只有与用人单位提供的生产资料相结合在实现劳动过程中才能与用人单位产生劳动关系，没有劳动过程便不可能形成劳动关系；
3、劳动者与用人单位间的劳动关系具有排他性。劳动关系只能产生于劳动者与用人单位之间，劳动者与其他社会主体之间发生的社会关系不能称之为劳动关系；
4、劳动关系的存在以劳动为目的。
法律依据：《中华人民共和国劳动法》
第十五条 禁止用人单位招用未满十六周岁的未成年人。
文艺、体育和特种工艺单位招用未满十六周岁的未成年人，必须遵守国家有关规定，并保障其接受义务教育的权利。
