释义	没有营业执照，就属于无照经营。通常情况下，无照经营归工商行政管理部门查处但是有一些需要行业主管部门管理的经营行为，未取得前置许可审批，也未取得营业芹顷执照的，应该由前置许可部门查处。法律依据：《个体工商帆橡户条例》第八条申请登记为个体工商户，应当向经营场所所在地登记机关申请注册登记态首旁。申请人应当提交登记申请书、身份证明和经营场所证明。个体工商户登记事项包括经营者姓名和住所、组成形式、经营范围、经营场所。个体工商户使用名称的，名称作为登记事项。
