释义	员工辞职公司不批，员工离职无需征得用人单位的同意。法律规定，劳动者提前30日书面形式通知单位，可以解除合同。如果是在试用期的，可以提前三日通知用人单位解除；如果用人单位未及时缴纳社保、支付劳动报酬、提供劳动保护或者劳动条件的，劳动者可以解除劳动合同，用人单位应当支付经济补偿金。法律依据：《中华人民共和国劳动合同法》第三十七条劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。
