小旅馆无证经营是什么罪？

依据我国相关法律的规定，旅馆无经营许可开业的，由工商管理部门依法进行处罚，而公安机关应当协助工商行政管理部门依法处理。
【法律依据】：
《中华人民共和国治安管理处罚法》 第五十四条 未经许可，擅自经营按照国家规定需要由公安机关许可的行业的处十日以上十五日以下拘留，并处五百元以上一千元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。对无证经营的旅馆，予以取缔。
