释义	离婚扶养义务没有强制性，只有当夫妻一方因生活困难、丧失劳动能力、无固定收入、缺乏生活来源、年老、患病等原因，无独立生活能力确实需要扶养；对方有扶养能力的，需要扶养的一方才有要求其给付扶养费的权利。【法律依据】《中华人民共和国民法典》第一千零五十九条夫妻有相互扶养的义务。需要扶养的一方，在另一方不履行扶养义务时，有要求其给付扶养费的权利。第一千零九十条离婚时，如果一方生活困难，有负担能力的另一方应当给予适当帮助。具体办法由双方协议；协议不成的，由人民法院判决。
