商品未交付风险就由买受人负担的情况有什么 |

标的物未交付，风险转移给买家有三种情况：1.买家延迟受领，标的物毁损、灭失的风险自违约时起由买家承担；2.在途货物买卖，毁损、灭失的风险自合同成立时起由买家承担；3.买家延迟提货，毁损、灭失的风险自违约时起由买家承担。
法律分析
标的物尚未交付的风险已经转移给买受人承担的情况有三种。第一种是买受人延迟接受。如果出卖人按照约定将标的物放置在交付地点，但买受人违反约定没有接收，那么标的物的损坏或灭失风险会从违约时起由买受人承担。第二种是在途货物的买卖。如果出卖人出售在途标的物并委托承运人运输，除非当事人另有约定，否则在合同成立时起，标的物的损坏或灭失风险由买受人承担。第三种是买受人延迟提货。如果由于买受人的原因导致标的物未按照约定期限交付，那么买受人应自违约时起承担标的物的损坏或灭失风险。
法律依据
《民法典》第六百零五条
因买受人的原因致使标的物未按照约定的期限交付的，买受人应当自违反约定时起承担标的物毁损、灭失的风险。
