释义	侵权责任的过错责任是以行为人主观上的过错为承担民事责任的基本条件的认定责任的准则。按过错责任原则，行为人仅在有过错的情况下，才承担民事责任。没有过错，就不承担民事责任。法律依据《中华人民共和国民法典》第一千一百六十五条【过错责任原则】行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
