释义	集体合同和劳动合同虽然同属于调整劳动关系的依据，但是属于劳动法上不同性质的合同，所以集体合同既不能直接适用于我国民法上有关合同的规定．也能不直接适用于劳动法上关于劳动合同的规定。简单地说，集体合同的规定应首先适用国家和地方有关集体合同的规定．如果集体合同的专门规定中没有规定的，还可以适用国家和地方有关劳动合同的规定，若仍没有相应的规定，则适用民法的有关规定。
