构成故意伤害罪怎么处罚? |

法律分析：故意伤害罪，一般指的是犯罪嫌疑人在自己知道的情况之下，仍然通过非法的形式或手段损害他人身体健康的一种行为，故意伤害罪一般不包含故意侵害他人生命的行为，但是刑法中侵犯中国公民人身权利或者民主权利罪的一种。 一般故意伤害罪判多少年取决与犯罪人故意伤害造成被害人的受伤程度，根据伤害情况主要分为：轻伤、重伤、死亡三种情形，三种不同的情形所面临的判处的刑罚也是不同，如果致人轻伤的话，人民法院一般处以三年以下有期徒刑；如致人重伤的，一般判处三年至十年有期徒刑；若出现致人死亡的，处以10年以上有期徒刑，甚至依据事情情况可判处死刑。当然针对一些个别案例，具体要判决多少年还需要法院综合考虑很多因素，其中就包括有犯罪人否有自首、立功、赔偿被害人等情况。
法律依据：《中华人民共和国刑法》 第二百三十四条 故意伤害他人身体的，处三年以下有期徒刑、拘役或者管制。犯前款罪，致人重伤的，处三年以上十年以下有期徒刑；致人死亡或者以特别残忍手段致人重伤造成严重残疾的，处十年以上有期徒刑、无期徒刑或者死刑。本法另有规定的，依照规定。
