释义	法律分析：用人单位应当支付加班工资，但是却没有支付的，劳动者可以依法向劳动行政部门投诉，根据规定劳动行政部门应当依法处理。但如果劳动者是自己主动自愿加班，不是用人单位安排的话，则单位可以拒绝支付加班工资。法律依据：《中华人民共和国劳动争议调解仲裁法》第九条用人单位违反国家规定，拖欠或者未足额支付劳动报酬，或者拖欠工伤医疗费、经济补偿或者赔偿金的，劳动者可以向劳动行政部门投诉，劳动行政部门应当依法处理。
