释义	公寓满四十年后，公寓的国有土地使用权到期后自动续期。如果到期未申请续期的，土地使用权和地上房产由国家无偿收回，房屋所有权也就自然消失。如果提出续期申请，根据法律规定没有批准续期的(即根据社会公共利益需要收回的)，土地使用权国家无偿收回，但对于地上房产，根据收回时的残余价值给予相应补偿。现在，国家规定，住宅产权期满后可自动续期。法律依据：《民法典》第三百五十九条住宅建设用地使用权期限届满的，自动续期。续期费用的缴纳或者减免，依照法律、行政法规的规定办理。
