释义	律师解答：遗赠扶养协议是遗赠人和扶养人之间关于扶养人承担遗赠人的生养死葬的义务，遗赠人的财产在其死后转归扶养人所有的协议。在继承的过程中，如果有遗嘱或者遗赠的，优先适用遗嘱或者遗赠；如果没有遗嘱或者遗赠的，才适用遗赠扶养协议。【法律依据】：《中华人民共和国民法典》第一千零六十七条父母不履行抚养义务的，未成年子女或者不能独立生活的成年子女，有要求父母给付抚养费的权利。成年子女不履行赡养义务的，缺乏劳动能力或者生活困难的父母，有要求成年子女给付赡养费的权利。
