宅基地归谁所有？

法律分析：
宅基地农民集体所有。我国土地和房屋是分别实行管理的。根据规定宅基地是农民基于集体经济组织成员身份而享有的可以用于修建住宅的集体建设用地，农民无须交纳任何土地费用即可取得，是一种福利性质的，一般来讲不能继承。
法律依据：
《中华人民共和国土地管理法》 第九条 城市市区的土地属于国家所有。农村和城市郊区的土地，除由法律规定属于国家所有的以外，属于农民集体所有；宅基地和自留地、自留山，属于农民集体所有。
