法律分析：委托合同与中介合同的区别主要包括：
1、受托人的法律地位不同。在与第三人从事民事法律活动的过程中，受托人实际上处于类似委托代理人的地位。中介合同的受托人是中介。其不介入委托人与第三人签订的合同关系。在中介过程中，其只处于中介服务人的地位；
2、委托内容不同。委托合同中受托人接受委托的内容是办理委托事务。但在中介合同中，中介接受委托的内容仅限于向委托人报告订约机会或介绍委托人与第三人订约；
3、处理权利不一样。委托合同中的受托人在处理委托事务时，有权在委托权限内独立表示，对委托事务的处理有一定的独立决策权。中介合同中的中介在中介活动过程中，不涉及客户与第三方的订约活动；
4、合同有偿性不同。根据双方的协议，委托合同可以是有偿的，也可以是无偿的。但委托人在处理委托事务时支付的合理费用，必须由委托人承担。

第九百一十九条 委托合同是委托人和受托人约定，由受托人处理委托人事务的合同。
第九百六十一条 中介合同是中介人向委托人报告订立合同的机会或者提供订立合同的媒介服务，委托人支付报酬的合同。
