证人费用由谁承担

法律分析：证人因出庭作证而支出的合理费用，由提供证人的一方当事人先行支付，由败诉的一方当事人承担。法律规定费用由举证方当事人预交，这是证人出庭作证所支出合理费用预交的一般原则。证人出庭作证所支出的费用，法律规定由败诉方当事人承担，笔者认为这是一般原则，司法实践中应根据证言证明力的不同情况，决定这笔费用到底由谁承担。
法律依据：《最高人民法院关于民事诉讼证据的若干规定》 第五十四条 第三款 证人因出庭作证而支出的合理费用，由提供证人的一方当事人先行支付，由败诉的一方当事人承担。
