释义	当事人对行政处罚决定不服，可以自知道该具体行政行为之日起六十日内向复议机关提出行政复议申请;但是法律规定的申请期限超过六十日的除外。行政处罚不停止执行，法律另有规定的除外。【法律依据】《中华人民共和国行政处罚法》第六条，公民、法人或者其他组织对行政机关所给予的行政处罚，享有陈述权、申辩权；对行政处罚不服的，有权依法申请行政复议或者提起行政诉讼。
