释义	如果保险合同中已指定了受益人，在被保险人死亡后，其人身保险金直接由受益人取得，而不能作为遗产由继承人继承。如果保险合同中未指定受益人，在被保险人死亡后，其人身保险金应作为被保险人的遗产按照继承的程序处理。法律依据：《中华人民共和国民法典》第一千一百二十二条遗产是自然人死亡时遗留的个人合法财产。依照法律规定或者根据其性质不得继承的遗产，不得继承。
