释义	法律分析：诉讼费不是全部退回。诉讼退费是当事人从人民法院退出预收和结算的余额部分，也就是当事人预交的诉讼费超过实际应交纳的部分的话就退给当事人，顾名思义就是诉讼费多退少补。法律依据：《最高人民法院关于适用〈诉讼费用交纳办法〉的通知》：《诉讼费用交纳办法》第二十九条规定，诉讼费用由败诉方负担，胜诉方自愿承担的除外。对原告胜诉的案件，诉讼费用由被告负担，人民法院应当将预收的诉讼费用退还原告，再由人民法院直接向被告收取，但原告自愿承担或者同意被告直接向其支付的除外。
