释义	专利权侵权行为的认定是：构成专利侵权行为的要件包括两个方面：形式条件和实质条件。一、形式要件(1)实施行为所涉及的是一项有效的中国专利;(2)实施行为必须是未经专利权人许可或者授权的;(3)实施行为必须是以生产经营为目的。二、实质要件构成专利侵权的实质要件，也就是技术条件，实质实施行为是否属于专利的保护范围。如果行为人所涉及的技术特征属于专利权的保护范围，那么该行为人就构成了专利侵权。法律依据《中华人民共和国专利法》第十一条、第六十条、第六十一条、第六十五条
