释义	法律分析：合同就是协议，协议绝大多数是合同，只有涉及婚姻、收养、监护等有关身份关系的协议不适用民法典，这些协议也就不能称之为法律上或者民法典上的合同而称之为其他协议。合同与协议虽然有其共同之处，但两者也有其明显区别。合同的特点是明确、详细、具体，并规定有违约责任;而协议的特点是没有具体标的、简单、概括、原则，不涉及违约责任。从其区别角度来说，协议是签订合同的基础，合同又是协议的具体化。法律依据：《民法典》第二条民法调整平等主体的自然人、法人和非法人组织之间的人身关系和财产关系。
