释义	假期工可以向劳动部门投诉，或向劳动争议仲裁委员会申请劳动仲裁。要求单位支付拖欠的工资和因未签书面劳动合同而应支付的双倍工资。劳动者因被拖欠工资发生争议时，应先向用人单位提出支付的要求，主动与用人单位沟通协商。多数用人单位会考虑到诉讼成本和造成的负面影响，会同意支付合理工资的要求。在双方达成一致意见后，劳动者可与用人单位签订和解协议，但要注意该协议并无强制执行力。《工资支付暂行规定》第九条，劳动关系双方依法解除或终止劳动合同时，用人单位应在解除或终止劳动合同时一次付清劳动者工资。
