释义	医疗事故是指医疗机构及其医务人员在医疗活动中，违反医疗卫生管理法律、行政法规、部门规章和诊疗护理规范、常规，过失造成患者人身损害的事故。确定是否为医疗事故目前需要医疗事故鉴定委员会鉴定才能认定。医疗事故有五个构成要件：(1)医疗事故的主体是合法的医疗机构及其医务人员(2)医疗机构及其医务人员违反了医疗卫生管理法律、法规(3)医疗事故的直接行为人在诊疗护理中存在主观过失(4)患者存在人身损害后果(5)医疗行为与损害后果之间存在因果关系。
