释义	法律客观：《最高人民法院关于适用的解释》第六十七条下列人员不得担任刑事诉讼活动的见证人：（一）生理上、精神上有缺陷或者年幼，不具有相应辨别能力或者不能正确表达的人；（二）与案件有利害关系，可能影响案件公正处理的人；（三）行使勘验、检查、搜查、扣押等刑事诉讼职权的公安、司法机关的工作人员或者其聘用的人员。由于客观原因无法由符合条件的人员担任见证人的，应当在笔录材料中注明情况，并对相关活动进行录像。
