法律分析:
被起诉的人正在服刑，可以把被起诉人从羁押场所提到法院开庭，法院可以到监狱等羁押场所开庭，法院不能缺席审理服刑人员案件，起诉正在服刑犯罪分子的，由原告所在地人民法院管辖。
法律依据:
《中华人民共和国民事诉讼法》 第二十三条 对被监禁的人提起的民事诉讼由原告住所地人民法院管辖。
