法律主观：
1、申请立案监督一般是当事人认为公安机关该立案而不立案的，可以向检察机关提出申诉，要求检察机关予以立案监督。 2、公安机关在收到人民检察院《要求说明不立案理由通知书》后七日应当将说明情况书面答复人民检察院。人民检察院认为 公安机关不立案 理由不能成立，应当将有关证明应该立案的材料同时移送公安机关。
法律客观：
《 刑事诉讼法 》第一百条 人民检察院在审查 批准逮捕 工作中，如果发现公安机关的侦查活动有违法情况，应当通知公安机关予以纠正，公安机关应当将纠正情况通知人民检察院。
