释义	法律主观：劳动合同中的基本工资低于当地最低工资标准是可以的。如果合同期间的实际工资低于当地最低工资标准的，用人单位就违反了《劳动合同法》。用人单位与劳动者约定的劳动报酬标准不得低于当地人民政府规定的最低工资标准。而所谓的劳动报酬是指除加班工资以外的实发工资总额。因而要看公司的工资结构，如果工资结构只有基本工资一项，那么基本工资应当等于或者大于最低工资标准;如果工资结构包括基本工资/提成/补贴等，则要看实发工资总额是否低于最低收入而不是对单纯的看基本工资。
