释义	法律分析: 若是在婚姻关系存续期间夫妻一方失去独立生活能力，另一方拒绝扶养的话，情节严重的话，则会构成遗弃罪。行为人会被处五年以下有期徒刑、拘役或者管制。《中华人民共和国刑法》第十四条【故意犯罪】明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
