释义	法律分析: 或裁或审制度是仲裁法基本制度之一，是指当事人选择解决争议途径时，在仲裁与审判中，只能二者取其一的制度。当事人选择了以仲裁途径解决争议，就不可以再选择诉讼;当事人若选择了诉讼就不可以同时选择仲裁。法律依据: 《中华人民共和国仲裁法》第四条当事人采用仲裁方式解决纠纷，应当双方自愿，达成仲裁协议。没有仲裁协议，一方申请仲裁的，仲裁委员会不予受理。第五条当事人达成仲裁协议，一方向人民法院起诉的，人民法院不予受理，但仲裁协议无效的除外。
