主债务履行期届满后签订的保证合同有效吗
释义
主债务履行期届满后签订的保证合同是有效的。法不禁止即自由不仅是法治国家对“民”的一项承诺，而且也是法治国家普遍信奉的一项法治原则。保证人对已经超过诉讼时效期间的债务承担保证责任或者提供保证的，又以超过诉讼时效为由抗辩的，人民法院不予支持。
