释义	法律分析: 犯罪是经过生效判决确定后的确定状态，那么在此生效判决确定之前都应该是涉嫌犯罪的状态。同样是涉嫌犯罪在刑事诉讼中的不同阶段特定称谓也有所不同，在侦查、审查起诉阶段都称为犯罪嫌疑人，案件起诉到法院后变为被告人，表示进入诉讼被控诉的身份，但并不能因身份称谓就说明犯罪，更不能称为罪犯。法律依据: 《中华人民共和国刑法》第十二条未经人民法院依法判决，对任何人都不得确定有罪。
