释义	犯罪以前有案底已经受过刑事处罚的，一般是不会追究的。但是如果以前犯黑社会组织犯罪，后又犯黑社会组织性质的犯罪。构成特别累犯，是需要从重处罚的。法律依据《中华人民共和国刑法》第六十六条危害国家安全犯罪、恐怖活动犯罪、黑社会性质的组织犯罪的犯罪分子，在刑罚执行完毕或者赦免以后，在任何时候再犯上述任一类罪的，都以累犯论处。
