释义	用人单位在与劳动者协议确定服务期年限时要遵守两点：第一，要体现公平合理的原则，不得滥用权利。第二，用人单位与劳动者约定的服务期较长的，用人单位应当按照工资调整机制提高劳动者在服务期间的劳动报酬。《中华人民共和国劳动合同法实施条例》第二十六条规定，用人单位与劳动者约定了服务期，劳动者依照劳动合同法第三十八条的规定解除劳动合同的，不属于违反服务期的约定，用人单位不得要求劳动者支付违约金。
