释义	划拨土地使用权指的是土地使用者经县级以上人民政府依法批准，在缴纳补偿、安置等费用后所取得的或者无偿取得的没有使用期限限制的国有土地使用权。《中华人民共和国土地管理法》第54条规定，建设单位使用国有土地，应当以出让等有偿使用方式取得；但是，下列建设用地，经县级以上人民政府依法批准，可以以划拨方式取得：（一）国家机关用地和军事用地；（二）城市基础设施用地和公益事业用地；（三）国家重点扶持的能源、交通、水利等基础设施用地；（四）法律、行政法规规定的其他用地。
