释义	聚众犯罪是法律规定以聚众作为构成犯罪必要要件的犯罪。中国刑法中规定有聚众犯罪，并且可以分为两类：（1)属于共同犯罪的聚众犯罪，象持械聚众叛乱罪、聚众劫狱罪就属于此类型的聚众犯罪。（2)属于单独犯罪的聚众犯罪，象聚众扰乱社会秩序罪、聚众扰乱公共场所秩序或交通秩序罪，这些犯罪以首要分子作为构成犯罪的必要条件。中国刑法规定，对于聚众性犯罪，首要分子是刑法所打击的重点。法律依据《中华人民共和国刑法》第二百六十八条、第二百九十条、第二百九十一条、第二百九十二条
