房屋租赁合同是怎样认定为无效的 |

房屋租赁合同有下列情形之一的应当认定为无效：(1)签约主体不合格。当出租人或承租人不具备有效民事行为的主体构成要件，即主体不适格时，则所签订的房屋租赁合同无效。如无民事行为能力或限制民事行为能力未经法定代理人同意的自然人，或法人超出其权利范围所签订的房屋租赁合同。(2)内容不合法。主要包括一方以欺诈、胁迫的手段订立合同，损害国家利益的;恶意串通、损害国家、集体或者第三人利益的;以合法形式掩盖非法目的;损害害社会公共利益的;违反法律、法规强制性规定等情形。(3)客体不合格。房屋租赁合同中的标的物应当是法律、法规允许出租的房屋，根据相关规定，有以下情形的房屋不允许出租：司法机关和行政机关依法裁定、决定查封或者以其他形式限制房地产权利的;1、权属有争议的;2、属于违法建筑的;3、共有房屋未取得共有人同意的;4、不符合安全标准的;5、已抵押，未经抵押权人同意的;6、不符合公安、环保、卫生等主管部门有关规定的;7、出租房屋为名出租划拨土地使用权的;8、有关法律、法规规定禁止出租的。
