释义	正常情况下非法同居是不犯法的，如果男女双方在已婚情况下有非法同居的行为，可对其在道德上进行谴责。但如果当事人是在有配偶的状态下，还与他人以夫妻名义在外共同居住生活，那么当事人就会因构成重婚罪，而被司法机关追究刑事责任，即被法院判处二年以下有期徒刑或者拘役。法律依据: 《中华人民共和国民法典》第一千零四十二条禁止包办、买卖婚姻和其他干涉婚姻自由的行为。禁止借婚姻索取财物。禁止重婚。禁止有配偶者与他人同居。禁止家庭暴力。禁止家庭成员间的虐待和遗弃。
