释义	法律分析：侵犯商业秘密的行为能构成犯罪。侵犯商业秘密，涉嫌下列情形之一的，应予立案追诉： (一)给商业秘密权利人造成损失数额在五十万元以上的; (二)因侵犯商业秘密违法所得数额在五十万元以上的; (三)致使商业秘密权利人破产的; (四)其他给商业秘密权利人造成重大损失的情形。法律依据：《中华人民共和国刑法》第二百一十九条为境外的机构、组织、人员窃取、刺探、收买、非法提供商业秘密的，处五年以下有期徒刑，并处或者单处罚金;情节严重的，处五年以上有期徒刑，并处罚金。
