释义	（1）新房开发商在售房时五证不全，本身就属于违法行为；（2）认购书或购房合同中，对于退定金的条件有约定的话，只要情况符合退定金的条款，都可依据认购书或购房合同让开发商退定金。法律依据：《中华人民共和国民法典》第五百八十七条当事人可以约定一方向对方给付定金作为债权的担保。债务人履行债务后，定金应当抵作价款或者收回。给付定金的一方不履行约定的债务的，无权要求返还定金受定金的一方不履行约定的债务的，应当双倍返还定金。
