释义	优先承租权，一般指租赁合同到期后，原承租人在同等条件下，享有优先与出租人签订租赁合同的权利。我国法律及司法解释中，没有关于优先承租权的相关规定，所以优先承租权并不是一项法定权利，法律上只规定了承租人在同等条件下具有“优先购买权”，并没有“优先承租权”。【法律依据】《民法典》第五百零二条，依法成立的合同，自成立时生效，但是法律另有规定或者当事人另有约定的除外。
