释义	上海不是所有房子的租金都由当事人协商确定，公有居住房屋、以行政调配方式出租的非居住房屋、政府投资建造的公益性非居住房屋按照市人民政府规定的标准执行。法律依据：《公共租赁住房管理办法》第十九条市、县级人民政府住房保障主管部门应当会同有关部门，按照略低于同地段住房市场租金水平的原则，确定本地区的公共租赁住房租金标准，报本级人民政府批准后实施。公共租赁住房租金标准应当向社会公布，并定期调整。第二十条公共租赁住房租赁合同约定的租金数额，应当根据市、县级人民政府批准的公共租赁住房租金标准确定。
