释义	法律分析：按现行法律规定，并没有明文规定合同生效多少日未履行，即为无效合同。以合同内容看，如果因未履行导致合同履行不能，违背合同约定目的，就算作废，也算过错方违约。但是如果存在法律规定的情形的，合同无效，合同中的条款符合法律规定的无效情形的，该条款无效。法律依据：《中华人民共和国合同法》第一百零七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
