释义	（1）需经本村村民委员会同意和乡级政府的批准；（2）转让人与受让人同为本村村民；（3）受让人无宅基地，符合宅基地申请条件；（4）宅基地使用权不能单独转让，须与住房一并转让。另外，转让人户口应该已迁出本村或属于“一户多宅或多房”。如系一户一宅，须明确表示不再申请宅基地，且有证据表明其已有住房保障，如与其他近亲属合户居住。符合以上条件，房屋买卖才能万无一失。关于农村宅基地的自由流通现在国家已经在进行一些试点，但是法律还没有改变，暂时无法实现自由买卖。
