释义	对于第二审人民法院发回重审的案件，上诉人预交的上诉案件受理费不予退还。对一、二审人民法院的全部诉讼费用，由原审法院根据重审的处理结果，按照法院收取诉讼费的规定标准和办法，确定诉讼费用的负担。并在司法文书中予以注明。对于第二审人民法院发回重审的案件，原审法院作出判决后，原先已交上诉案件受理费的当事人再行上诉，应当免交上诉案件受理费。
