企业上班时间超过八小时
释义
法律分析:要根据工作性质来判断。根据相关规定,国家实行八小时工作制度,即劳动者每天工作时间不得超过八小时,每周工作时间不得超过四十四小时。超出这个时间且不给加班费就是违法的。但是由于生产、工作等需要,用工单位在征得工会同意的前提下须与劳动者协商延长工作时间,即加班。但是加班也不是无限制的延长工作时间,用工单位要根据劳动者的身体状况适当延长一至三小时。
法律依据:《中华人民共和国劳动法》 第三十六条 国家实行劳动者每日工作时间不超过八小时、平均每周工作时间不超过四十四小时的工时制度。
