释义	交付使用的房屋存在一般的质量问题，购房人不能要求解除合同（退房），但如在保修期内，开发商应当承担修复责任；开发商拒绝修复或者在合理期限内拖延修复的，购房人可以自行或者委托他人修复。修复费用及修复期间造成的其他损失由开发商承担。法律依据: 《城市房地产开发经营管理条例》第三十二条商品房交付使用后，购买人认为主体结构质量不合格的，可以向工程质量监督单位申请重新核验。经核验，确属主体结构质量不合格的，购买人有权退房；给购买人造成损失的，房地产开发企业应当依法承担赔偿责
