释义	法律分析：婚内出轨，是否构成犯罪，还得看实际情况，若能证明其与他人以同居名义生活，则构成重婚罪。重婚罪的客观方面表现为行为人必须具有重婚的行为。即有配偶的人又与他人结婚的，或者明知他人有配偶而与之结婚的，就构成重婚罪。但若其不满足重婚罪的构成条件，那么其很大程度上是受到道德的谴责，可能会认定为违背了社会的公序良俗原则，但不会构成刑事犯罪，即轻微违法不犯罪。法律依据：《民法典》第一千零四十二条第二款规定，禁止重婚。禁止有配偶者与他人同居。
