释义	首先，商标纠纷可以申请仲裁，因为双方只要自愿达成仲裁协议，就可以在发生纠纷时选择仲裁的方式解决。没有仲裁协议，一方申请仲裁的，仲裁委员会不予受理。并且商标纠纷不属于不能仲裁的纠纷，所以商标纠纷可以申请仲裁。法律依据《仲裁法》第三条，下列纠纷不能仲裁：一婚姻、收养、监护、扶养、继承纠纷；二依法应当由行政机关处理的行政争议。第四条当事人采用仲裁方式解决纠纷，应当双方自愿，达成仲裁协议。没有仲裁协议，一方申请仲裁的，仲裁委员会不予受理。
