释义	律师分析： “激情杀人”是刑法理论上激情犯罪的一种。故意杀人根据主观恶性的不同，实践中往往对情节较轻的几类犯罪从轻或减轻量刑，如防卫过当的故意杀人、基于义愤的杀人、被害人刺激下的激情杀人、受被害人请求的杀人等等。我国的刑法并没有明确规定“激情犯罪”，但是在立法和审判实践中还是考虑了与“激情犯罪”有关的因素，很可能会在量刑时从宽。【法律依据】：《中华人民共和国刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。
